Can I file a case against a Tax Cut program?

I completed my Federal tax return for 2007 and 2008 using a company's Tax Cut program. I was audited by the IRS. I had claimed Real Estate Professional based on the tutorial in the program. The IRS did not agree. I had to pay additional tax that I feel that the company is responsible for. We have corresponded, they do not feel responsibility. I would like to file an action against them.
